Speech to the
Josephine County Commissioners, 05/20/09.
A couple weeks ago, Commissioner Ellis asked Ward Ockenden
if he had yet talked to his state representative about his problems with Oregon’s
bizarre land use laws, and Ward said that he figured that was his next
step.
But if you, as Commissioners, agree with him, then you
should also speak to the legislature about fixing or repealing Senate Bill
100. You may not be elected to represent
us in the legislature, but you do
represent us and we want you to speak for
us to the legislature for the benefit of the citizens of this county.
Likewise, I ask you to speak to our legislature, by
resolution of the Board, about restoring at least some of the freedom that we
once had regarding marijuana and hemp.
Please ask the state legislature to pass the Oregon Cannabis Tax Act,
also known as 2008’s Measure 28, with suitable amendment to allow and limit growing of marijuana for personal

This measure would remove all regulation from hemp. It would replace all state marijuana laws and
place marijuana, defined as cannabis having a minimum percentage of THC, on the
same footing as alcohol: licensing growers who would sell it to the state;
processors who would process it for the state; and having the state sell it to
us through our pharmacies at cost and through state liquor stores for profit. While it contains no penalties for growing
for personal use, it also does not specifically allow or limit such growing.
True, it didn’t make the ballot. There was too much happening last year for
people to pay attention, and the time was not ripe.
But the time is ripe now.
Obama was elected. His Attorney
General has declared that the federal government will not interfere with state
marijuana laws. There are several bills
before the House and Senate to adjust Oregon’s medical marijuana law in several
directions.
This one is superior to all of them, as it removes the
medical privilege from marijuana possession and use. We are supposed to be a nation of laws and
rights, not privileges. We all have an
equal right to God’s green herbs.
In Genesis, Chapter 1, when God made the world in 6 days,
everything he made was good. He gave
every green seed-bearing herb and fruit-bearing tree to man and animals for
food. Some were poisonous, but God left
that for us to figure out. Our
governments should also leave such choices to us.
